ONLLY.ART BUSINESS
Effective date: 2 August 2026. These Business Terms govern access to onlly.art Business. They supplement the Business Licence and the request-specific licence record supplied for approved artwork requests. If documents conflict, the request-specific licence controls for that request.
A public plan request records commercial interest only. It is not an automatic purchase, licence grant, download right or account activation. A Business agreement begins only after we confirm the applicant, intended use and commercial terms, receive the agreed payment, and activate Business mode for the approved company.
A plan belongs to one approved business entity. Access may be used only by the approved users under the selected plan. The account may not be shared with independent companies, customers, resellers or unrelated contractors. We may pause access while resolving a verification, payment, rights, security or material misuse issue.
Starter and Studio include a monthly allowance of selected artworks. One artwork means one selected design, even where the standard production set includes up to six files. Allowance is reserved when an eligible production request is submitted. Unused allowance does not roll over unless a written agreement says otherwise. A request rejected by onlly.art for rights or source-quality reasons does not consume allowance; a customer cancellation before preparation normally releases it.
Unlimited covers recurring standard artwork requests for one approved business, subject to reasonable fair use and production capacity. It does not include bulk catalogue export, digital-file resale, unlimited manual restoration or redesign, use by unrelated companies, or simultaneous unrestricted production queues. Large sustained batches may require scheduling or a separate enterprise agreement.
The standard production set is JPEG and PDF in 3:4, 4:5 and 5:7 ratios. Files are prepared after a request, not made available as an instant bulk download. Standard requests are normally prepared within 4-24 business hours, subject to request volume, source quality, rights review and quality control. A published service window is an operational target, not an absolute delivery guarantee.
Only artworks marked Business Approved can be selected for commercial requests. Availability may change because of territory, source status, intended use, quality or legal review. Business catalogue status is not a blanket copyright transfer, an exclusive right, or a promise that every retail listing is available for Business use. We may decline, substitute, pause or remove a specific artwork request when review identifies a rights or production concern.
Commercial physical-print use is limited to the approved company, plan, territory, channels and use case recorded in the applicable Business Licence. Digital resale, redistribution, sublicensing, account sharing and use outside a documented scope are prohibited. You remain responsible for your own product listings, local law, advertising claims, taxes, customer terms, and the context in which physical products are produced or sold.
Plans renew manually until automated billing is introduced. Contact the Business team before the next billing period if you do not intend to renew. Refund, cancellation and credit decisions depend on the stage of preparation, any delivered files and the written commercial agreement. We may terminate or suspend a Business account for material breach, non-payment, rights misuse, security abuse or false application information.
Some source artworks are in the public domain. onlly.art does not claim exclusive copyright in an underlying public-domain work. The Business product includes rights review, file preparation, formatting, delivery, service and contractual permission to use delivered production files within the agreed scope.
To the maximum extent permitted by law, onlly.art is not liable for indirect, incidental, lost-profit or consequential loss arising from a Business request or use of a delivered file. Any liability is limited to the amount paid for the applicable Business service during the period giving rise to the claim. These pages are operational terms for the MVP and should be reviewed by qualified counsel before a broader international launch.
A White-label Art Catalog enquiry is not an instant platform activation, catalogue export, licence grant or payment. A pilot begins only after onlly.art and the approved partner agree the catalogue scope, territories, product mapping, production route, domain or integration, commercial pricing and operational responsibilities. Catalogue availability depends on rights, territory, intended use and source quality.
Unless a written agreement says otherwise, the partner controls the customer-facing domain, brand, product prices, checkout, taxes, delivery terms, customer service and physical fulfilment, and is the merchant of record. The partner is responsible for its end-customer terms, products, promotions, printed goods, returns, local legal compliance and any content supplied to the storefront. Physical production and fulfilment are not included in the platform price unless agreed separately.
A production release is the approved production package generated for one customer order line containing one artwork, selected product specification and authorised quantity. A repeat order normally creates a new release unless an agreement says otherwise. An onlly.art replacement caused by our preparation error does not consume a new release. A material product or size change after final approval may require a new release. Cancellation and refund treatment depends on the stage of the workflow and the Business Terms.
White-label access does not transfer copyright ownership, permit bulk export, digital-file resale or redistribution of source files. onlly.art may remove or pause an artwork from a partner catalogue where rights, territory, quality, security or source availability changes; new orders must not be exposed to unavailable works. Partners are responsible for verifying and maintaining their domain and webhook endpoints. Future webhooks require signed secrets, replay protection and least-privilege access.
In a partner-led model, the partner may be the controller of end-customer data and onlly.art may act as a processor for the minimal order data needed for the agreed production workflow. A separate data-processing agreement is required before a production integration that processes personal data. Full delivery addresses are not required by default where onlly.art does not fulfil physical delivery. Service availability, usage limits, overage, export, access removal and termination terms are confirmed in the applicable pilot or enterprise agreement.
